Psychiatrist finds man accused of assaulting a 0-year-old girl not criminally responsible

A psychiatrist who evaluated the man accused in March of assaulting a 10-year-old girl in Pointe-aux-Trembles has determined he was not criminally responsible for his actions.

A report on the evaluation was presented Wednesday to Quebec District Court Flavia Longo during a brief hearing at the Montreal courthouse.

“At this stage we want to review the report, but there was a conclusion that Section 16 of the Criminal Code would apply (in the 21-year-old Tanvir Singh’s case),” prosecutor Annabelle Sheppard told the judge.

The prosecutor referred to the section of the Criminal Code which states: “No one shall be criminally responsible for an act committed or an omission committed while suffering from a mental disorder which rendered the person unable to determine the nature and quality of the act or omission. or to know it was wrong.”

Lawyers on both sides of the case called for the contents of the report to be kept secret for now and for Singh’s case to be moved to June. A judge will determine whether they agree with the psychiatrist’s findings before declaring whether Singh’s case will be closed.

Longo told the prosecutor she had reservations about any of the conclusions in the report.

Outside the courtroom, Sheppard told reporters she had just received the report from the Philippe Pinel Institute and needed time to research it.

“Without going into details, if he is not found criminally responsible, it does not necessarily mean he will be released. It could mean he’s still being held at the (institute),” Sheppard said.

Singh was arrested in March after the girl was attacked. The child was walking along Tricentenaire Blvd. near Victoria St. with another young girl when she was repeatedly hit on the head and then dragged a short distance. Bystanders intervened and called 911.

The girl was treated in hospital for several days.

Her name is under a publishing ban intended to protect her identity.
